TERMS OF SERVICE
Last updated: [date]. Text in [square brackets] must be filled in or reviewed before this service goes public.
1. Who we are and what this is
These terms govern your use of the Starlit member portal, the Starlit loader and the software delivered through it (together, the "Service"). The Service is operated by [operator name and address] ("we", "us"). By creating an account you confirm that you have read these terms and the privacy policy and that you agree to them. If you do not agree, do not register.
2. Eligibility and accounts
- You must be at least [18] years old and legally able to enter into this agreement.
- Accounts are created by invitation only. An invite code is single use. Do not sell, trade or publish invite codes.
- You are responsible for everything done through your account. Keep your password secret and use a password you use nowhere else.
- You must give a working email address and keep it up to date. One person, one account.
3. Personal, non-transferable licence; no account sharing
We grant you a personal, non-exclusive, non-transferable, revocable licence to run the loader and the software it delivers on the computer(s) you have registered, for as long as you hold an active subscription. The licence is bound to you and to your registered hardware. You may not share your account, your login or the software with anyone, resell or sublicense access, circumvent or tamper with the loader, its protections, the hardware check or the server communication, extract, copy, decompile, redistribute or analyse the software, or use the Service to attack or abuse the Service itself.
4. Subscriptions and payment
- Access to the loader and the software requires an active subscription. Plans, lengths and prices are shown on the subscription page and may change for future purchases; a purchase made at a shown price is not changed afterwards.
- Payment is made in cryptocurrency to an address generated for your order. Time is added to your account after the payment has been confirmed on the network. You are responsible for sending the exact amount to the exact address before the quote expires; payments that are late, too small or sent on the wrong network may not be credited automatically, and we may, but are not obliged to, credit them manually.
- Cryptocurrency transactions are final. Network fees are yours.
- When a subscription ends, access ends; your account and invite remain.
5. No refunds
Because the Service is a digital product that is delivered immediately, there are no refunds after delivery (that is, once a payment has been credited to your account), except at our sole discretion and where the law of your country gives you a right that cannot be excluded. Time lost because your account was suspended for breaking these terms is not refunded.
6. Hardware identification and anti-abuse data
To enforce the licence and to protect the Service we collect hashed identifiers of your computer's hardware and your IP address when you use the loader and the website, and we keep logs of logins, downloads and loader checks. A subscription is limited to the number of devices shown on your account page. Details are in the privacy policy.
7. Suspension and termination
We may suspend or terminate your account, with or without notice, if we believe you have broken these terms, shared your account, attempted to bypass the licence or hardware check, charged back or disputed a payment, or abused the Service or other people. You may stop using the Service at any time and ask us to delete your account. On termination for breach your remaining subscription time is forfeited. Sections that by their nature should survive (including 3, 5, 8, 9 and 10) survive termination.
8. Software provided as is; no warranty
The loader and the software are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or compatibility with any game, system, third-party service or anti-cheat. Using third-party software with online games may violate their rules and may lead to bans or other consequences; you use the Service entirely at your own risk and we are not responsible for any account, item, ban or loss on any third-party service. We may change, suspend or discontinue any part of the Service, including by pausing delivery or updating the minimum loader version, at any time.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profit, accounts or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [3] months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction, subject to any mandatory consumer rights you have where you live.
11. Changes to these terms
We may update these terms. The date at the top shows the current version. If you keep using the Service after a change you accept the new terms; if you do not accept them, stop using the Service and ask us to delete your account.
